Introduction

Cyber laws and artificial intelligence are interconnected to each other where cyber laws deals with the regulation on the fair uses of computers and internet is a place where billion of people are connected to each other for various purposes and so it is important to make such rules and regulations so it could not be misused for criminal activities now the question comes what is ai , AI is set of technologies that enables the computer to perform various advanced functions including ability to see ,understand and transfer or adapt itself according to the requirements somewhere AI is far more dangerous then the internet because internet was only a platform of connecting people and gathering information from humans and help others with those information where AI is a technology which has the ability to gather information from the internet and it has the ability to make changes in it and ai is a dynamic technology which has the ability of continuously growing and developing itself and so this is a new problems for cyber laws that how to stop AI from continuously gathering information and how far it could gather information and use it.

Factors Affecting Continuous Growth of AI

There are various factors that are affecting the continuous growth of ai some of them are as following:

1. Data Availability: Now in the modern times ai could easily access data of anyone it is because of our dependency on the internet and technology there had been various occasion where you have visited a website and they had given you a terms and condition paper and without even reading it you have just give your permission to it we should not do that we should first read that then only we should give permission to it.
2. Improvement in Computing Power: Now there are various companies which are working for the improvement in technology of computers we see in our daily lives that something new has been launched or new hardwereand softwere comes in the market these all are helping in the improvement of computing power.
3. Advance Algorithms: Algorithmis something which analysis the data of consumers and provide them things which they were looking for it keeps a check on the user behaviour , in your lives you had seen various occasion where you are looking for something and suddenly you started getting advertisement of same thing and recommendation for the same thing all the digital platforms like Instagram,facebook , twitter,linkdin,flipkart they all use this technique to make their app more entertaining and provide their user a easy access to the things which they were looking for and make their app user friendly.
4. Increased Investment: Investment in technological sector has been increasing at a very rapid speed and it a good sign for the growth of gdp and overall growth of Indian economy in the year 2023 india had invested 1.4 billion doller in the ai which makes it in the top 10 countries for ai investment the future is in ai so it is important to make more investment in the ai as india is a developing country if it has to come under the ambit of developed country it has to make investment in their it sector that is the one of the ways by which india’s economy could grow at rapid speed.
5. Increased Business and Consumer Adoption: AI is something which could make a work that requires a lot of hardwork it could make things easier ,we should not always indulge ourself in doing hardwork if we have a platform that could make it easier we should use that platform in our daily lives our even at our professional works otherwise others will use that thing and make growths in their lives and in their professional lives so as ai is growing the consumer are also adopting it with the same speed to make their work easier and with the intent of growing at a higher speed than others.

How AI is using our Personal Data

there are various ways how ai is using our personal data some of them are as following :

1. Personal and Recommendations: There would have many times you would have started searching something on youtube, google, twitter, Instagram and they would have started showing you the same things again again on your feed or recommendation so it is pretty clear from this that ai is somewhere breaking our privacy and they are using it to show the same things or things which are similar to what we had searched it is not wrong until they start using that data of ours to do criminal activities.
2. Targeted Advertising: Targeted advertising refers advertisement in a way that shows things to someone who would be interested in buying it and not showing to someone who would just ignore it and move ahead it is one of the most effective and efficient way of advertising on online platforms.
3. Voice Assistants: Voice assistants such as siri, alexa, and google assistance are very advanced and they have almost answers to all of our questions and with the time they are learning to be very user friendly and they could talk to us as a human being recommend us something about our personal and professional life and they are somewhere trying to replace human being by being so friendly and almost acting like a human would have acted and to do that it requires allot of data of human being so somewhere they are using our data to know when and what are things that could make usangry,happy,sad so they clearly have our data.
4. Behaviour Analysis: You must have heard somewhere that all our activities which we are doing on the mobile phones are being watched by someone now the ‘someone’ they were talking about was non other than the algorithm that analysis all our activities on the online platforms and somewhere it gets to know what I like and what I dislike and then eventually it shows me thing that I would like this is something what we call behavioural analysis it analysis our behaviour and shows me things according to it.
5. Predictive Analytics: As I already discussed how they are analysing our behaviour so it is pretty clear that they would be able to know how would I react to something or what would be my first reaction so this is something we could say being predictive about someone’s behaviour, for example = you know your father very well so you would be able to predicttheir behaviour in various situations that how would he will act in a particular situation.

Cyber Laws In India

1. Information and Technology Act 2000 (IT ACT): It’s the primary act in india that deals with cybercrime and electronic commerce and it was the first act that had dealt with such crimes and offences this act had defined various offences related to breach of data and privacy of an individual and provides punishments and penalties for them this act also talks about intermediaries and their power and fuctions. Some of its main provisions are privacy of individuals,digitalsignature,cybercrimes,and confidentiality etc.
2. IT Amendment Act 2008: It was an amendment to the old IT ACT (2000) it had introduced various new provisions and it had tighten the cybersecurity measures it was the act that had introduced the NCIIPC alegal framework was established for digital signatures this act covers cyber forensics it had penalized the offensive messages and various new things were introduced through this act.
3. Digital Personal Data Protection Act (2023): It was passed on august 2023 by the parliament of india it was the first initiative for the protection of personal data , personal data is something which is the most essential thing in the modern times the main provision of it includes consent of the individuals before accessing their data,it imposes punishments and penalities for breach of data,it has established data protection board which work for the protection of personal and consequence of non compliance of it.
4. The National Cyber Security Policy 2013: It was developed by the government of india’s department of electronics and information and technology to protect the country’s information infrastructure and cyberspace it aims to protection of country cyberspace ecosystem it had strengthening the regulatory framework ,establishing a national critical information infrastructure protection centre(NCIIPC) encouraged the organization to establish an chief information security officer(CISO) and many more new provision had initiated by this act.
5. Criminal Laws: The new bns and bnss had made many new provisions regarding the cyber laws and protection of personal data like bnssection 111 covers cyber crime section 356 COVERS DEFAMATION THROUGH digital platforms,section43Acovers talks about companies negligence to maintain personal data of users the new bnss had also started recognizing online evidence audio video evidence there are new sections established for that like section 2(1)(a),2(1)(i),section 54 talks about identification of person arrested by another person can be done by electronic means , section 64 summons encrypted and electronic form can be issued and many more section were introduced in bnss.
